SpringTale Terms of Service

These Terms of Service ("Terms") govern your use of the SpringTale website, game, account services, and shop (collectively, "SpringTale"). SpringTale is provided by Cardigan Studios ("we", "us", or "our") from New South Wales, Australia.

By accessing or using SpringTale, you agree to these Terms and our Privacy Policy. If you do not agree, do not use SpringTale. If you use SpringTale on behalf of an organisation, you confirm that you have authority to accept these Terms for that organisation.

You are responsible for the activity on your account and for keeping your sign-in details secure. Provide accurate account information and notify us promptly at hello@cardiganstudios.com if you believe your account has been accessed without permission.

Do not misuse SpringTale. This includes interfering with the service or other players, attempting unauthorised access, using cheats or exploits, introducing malicious code, infringing another person’s rights, or using SpringTale in a way that is unlawful, abusive, or disruptive.

SpringTale may offer gems and other digital items. Gems are a limited, personal, revocable, non-transferable licence to access in-game content; they are not property, legal tender, or stored value, and cannot be redeemed for cash or transferred outside SpringTale except where required by law.

Gem purchases are processed through Stripe’s hosted checkout and are subject to Stripe’s terms. Prices are shown before checkout and are charged in the displayed currency. We do not store your full payment-card details. Our Refund Policy explains how we intend to handle gem-pack refunds, reversals, and chargebacks.

We may change, limit, or discontinue digital items or their availability as SpringTale evolves, subject to any rights and remedies that cannot be excluded under applicable law. Gems do not expire in the current version of SpringTale unless we clearly tell you otherwise before a change takes effect.

SpringTale and its software, artwork, characters, music, text, design, and other content are owned by or licensed to Cardigan Studios and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use SpringTale for its intended entertainment purpose under these Terms.

If you send us ideas, suggestions, or feedback, you allow us to use them without restriction or compensation. This does not affect rights you may have in personal information under our Privacy Policy or applicable law.

SpringTale may link to or use services provided by third parties, such as Steam, Discord, Supabase, and Stripe. Their services are governed by their own terms and privacy policies. We are not responsible for third-party services, content, or practices.

We may update, maintain, suspend, or discontinue all or part of SpringTale at any time. We will use reasonable efforts to keep the service available, but do not promise that it will always be uninterrupted, error-free, secure, or available in every location or on every device.

We may update these Terms from time to time. The updated Terms will be posted here with a new effective date. If a change materially affects your rights, we will take reasonable steps to notify you. Continuing to use SpringTale after the updated Terms take effect means you accept them, to the extent permitted by law.

To the maximum extent permitted by law, SpringTale is provided on an "as is" and "as available" basis. We do not make guarantees about the service beyond those that cannot lawfully be excluded.

Nothing in these Terms excludes, restricts, or modifies rights or remedies that cannot be excluded under applicable law, including the Australian Consumer Law. Where the law permits us to limit a remedy for a breach of a non-excludable guarantee, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

To the maximum extent permitted by law, Cardigan Studios is not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of data, profits, goodwill, or opportunity arising from your use of SpringTale.

You may stop using SpringTale at any time. We may suspend or terminate your access if we reasonably believe you have breached these Terms, harmed the service or other players, or created legal or security risk. Provisions that by their nature should continue after termination will survive termination.

These Terms are governed by the laws of New South Wales, Australia, and the laws of Australia that apply there. The courts of New South Wales have non-exclusive jurisdiction, except where applicable law gives you the right to bring a claim elsewhere.
